Abstract

Regarding the environment, today in the country we find jurisprudence of federal courts with a strong tendency to consider environmental pollution as a crime of danger - despite the resistance of the old jurisprudence limited to a closed look at the penal code - such is the case under analysis: “Luis Alberto Drube; Santiago Daniel Gasep affected Government of Santiago del Estero – La Trinidad” where a tension between both currents is observed.
