THE LEGAL REGULATION OF THE SOCIAL AND SOLIDARITY ECONOMY IN BRAZIL AND ARGENTINA. SOME CONSIDERATIONS

Abstract

With some differences in nuances regarding the fundamentals that explain it and the purposes that drive it, the social and solidarity economy has acquired in recent decades a growing relevance in the societies of the South American countries. The dynamic that observed in recent years the social and solidarity segment in Argentina and Brazil is part of this trend. The development of social and solidarity field in these two national scenarios installed in their societies the debate on the need to deepen the legal regulation of the sector. Taking this into account, this paper tries to characterize the current situation of the legal regulation of the social and solidarity economy in Brazil and Argentina as a central piece of the institutionalization process, highlighting the main aspects of the respective legal frameworks. The study shows that the absence of a specific federal law in the two States was not an obstacle to the development of provincial regimes for social and solidarity economy.
