The purpose of the work is to think about the “right to be forgotten” as a tool that allows balancing the “right to freedom of information” and the “right to informational self-determination “, today in conflict as a result of progress technology and the media. In addition, it raises the need for its positive regulation in national legislation in order to establish guidelines that allow limiting
its field of application, limited to the de-indexing of links in search engines of all information referring to the human or legal person that does not comply with the criteria of necessity and utility; and if there are investigative purposes, it can be searched by other parameters, without the need to maintain an easily detectable digital record.
