THE NORMATIVE IMPLICATIONS OF & QUOT; BENEFIT MENUS & QUOT; IN HEALTH, IN PRECEDENTS OF THE SUPERIOR COURT OF JUSTICE OF CÓRDOBA

The catalog of benefits of an entity that provides health services determines which are the goods or services that each beneficiary can access, and which are not. However, if the right to health has the constitutional importance that, at least in theory, is recognized, the question arises about how effective are the benefit menus to define what is covered and what is not. In other words, how much normative relevance do they have to define, ultimately, the range of benefits to be covered. This paper will try to find that answer in the jurisprudence of the Superior Court of Justice of Córdoba, through the pronouncements of its Electoral Chamber. In recent years, the local Court has had the opportunity to rule on various cases related to the right to health, about the proper interpretation of the scope of the benefit menus.
